Attendances by clerks

Criminal law payment rules

  • Preparation done by a clerk is paid at the same rate as that for the practitioner (on the basis that it is supervised by a solicitor). 
  • Attendances in court, group conferences, prison visits and traveling time is paid at 50% of the rate payable to the practitioner.

Audit requirements

File notes must be retained in the practitioner's file detailing:

  • who was in attendance
  • time taken
  • instructions taken
  • advice given.
