    Queensland Drug and Alcohol Court (QDAC) Additional Charges

    In circumstances where the in-house practice of LAQ have a conflict of interest that precludes them from representing a QDAC participant in relation to additional charges and the DAC5 grant of aid is issued to a preferred supplier there are two professional fee options, full fee and reduced fee.

    The full fee is payable when the practitioner appears at a sentence in QDAC or the Magistrates Court.

    The reduced fee is payable if:

    • Solicitor withdraws / transfer of solicitor
    • Client fails to appear (prior to sentence date)

    Queensland Drug and Alcohol Court (QDAC) Sentence

    In circumstances where the in-house practice of LAQ has a conflict of interest that precludes them from representing a defendant at a sentence in QDAC and the DAC2 grant of aid is issued to a preferred supplier there are two professional fee options, full fee and reduced fee.

    The full fee is payable when the practitioner appears at an eligibility hearing in QDAC and a sentence in either QDAC or the magistrates court.

    The reduced fee is payable if:

    • Solicitor withdraws / transfer of solicitor
    • Client fails to appear (prior to sentence date)

    Committal proceedings and matters referred to the Queensland Drug and Alcohol Court

    Under the initial committal grant (MR1) practitioners are able to claim only the preparation component and a mention fee if the matter is referred to the Drug and Alcohol Court for assessment.
