Process servers, court filing agents and bailiff fees

    Process Servers

    Payment rules

    Prior approval must be sought before incurring the cost of a process server. 

    The fees are only payable to a licensed process server and are detailed in the scale of fees. 

    Travel expenses are claimable in conjunction with the process server fees if the distance travelled exceeds 35km (round trip). 

    Travel time is not claimable in conjunction with process server fees. 

    Audit requirements

    Receipts must be retained on the practitioners file. 

    Costs incurred by using an agent to file documents at court

    Payment rules

    Legal Aid Queensland will pay reasonable expenses incurred by practitioners if they engage an agent to file documents (filing fee / filing agent / court lodging).

    Bailiff fees for serving documents

    Payment rules

    If a practitioner is unable to engage a process server or it is more cost effective to engage a bailiff Legal Aid Queensland will pay the fees associated with engaging the bailiff to serve documents.
