    Counsel preparation

    Interim hearing

    Where counsel is briefed for an interim hearing, the full fee is payable.

    Trial

    Counsel is entitled to the full amount of the preparation for trial grant if the brief was delivered to and accepted by counsel and preparation for trial was conducted.

    Opinion on family law appeal

    Where counsel is briefed to provide an opinion in relation to a family law appeal counsel is entitled to claim the fee provided they have produced an opinion on prospects of success of an appeal.

    Appeal (fee on brief)

    Where counsel is briefed for an appeal for a family law matter and the appeal proceeds, counsel is entitled to claim the full fee on brief.

    Counsel attendance at court

    Day one of trial

    Counsel is only entitled to claim the court attendance component for day one of trial if the matter proceeds to day one of trial and they represent the client or Independent Children’s Lawyer at trial.

    Additional days of trial

    Counsel is only entitled to claim the court attendance at additional days of trial if the matter proceeds beyond day one of trial and they represent the client or Independent Children’s Lawyer at the additional days.

    Additional days of appeal

    Counsel is only entitled to claim the court attendance component for additional days of appeal if the matter proceeds to additional days and they represent the client or Independent Children’s Lawyer at the additional days of appeal.
