    Guideline 9 – specialist medical procedures provides that applications for the separate representation of children with an intellectual impairment in relation to applications for special medical procedures are not subject to the means test or merits test.

    All applications received for the separate representation of children in QCAT proceedings will be referred to a grants manager for consideration.

    Documentary requirements

    An order from QCAT appointing the separate representative.

    Allocation of a solicitor

    All requests for the appointment of a separate representative in these matters must be referred to an in house separate representative in either Brisbane or a regional office in the first instance, conflicts excepted.

    Grant(s) of aid

    The grant of aid for a separate representative to peruse filed material is KCSR.

    Extension(s) of aid

    The following extensions of aid are available for a separate representative to:

    • KCS3 - Attend a preliminary mention/hearing.
    • KCS4 - Attend day one of a hearing at QCAT.
    • KCS5 - Attend at additional days of a hearing at QCAT.

    Review of decisions

    A decision to refuse legal aid for this type of matter may be appealed to the external review officer (refer to review of decisions).
