For legal aid to be granted for a psychiatric or medical specialist report the following tests must be satisfied:

    • the applicant has been provided aid for the substantive matter, and
    • the request meets the merits test.

If the number of hours sought by the medical specialist exceeds 12 hours or the report writer refuses to accept the scale of fees, the matter will be referred to a senior grants officer for consideration.

If the number of hours sought by a psychiatrist in a Child Protection matter exceeds 16 hours, the matter will be referred to a senior grants officer for consideration.

Requests for an interstate report writer are determined by the Assistant Director Grants.
