Cancellation or non-attendance fees

    Where a party is required to be interviewed/examined by a report writer and fails to attend the interview/examination, a maximum of one hour at the relevant hourly rate is payable as a cancellation/non-attendance fee. This fee will be provided if the failure to attend was beyond the party’s control and not as a direct result of the solicitor’s failure to advise the party.

    If a party fails to attend an interview/examination on more than one occasion, it will be rare for Legal Aid Queensland to fund more than one cancellation/non-attendance fee.

    Requirements

    Extension of aid requests received from preferred suppliers or in-house practitioners

    Practitioners seeking an extension of aid for a cancellation fee or non-attendance fee should electronically submit an extension for aid request via the Grants Online system.

    Grant(s) of aid

    The grant of aid for a cancellation/non attendance fee for a psychologist is PY11.

    The grant of aid for a cancellation/non attendance fee for a social worker is SW6.

    The grant of aid for a cancellation/non attendance fee for a psychiatrist is MS2.

    Review of decisions

    A decision to refuse legal aid for this type of matter may be appealed to the external review officer (review of decisions).
