For legal aid to be granted for photocopying the following tests must be satisfied:

    • aid has been provided for the substantive matter
    • there is a large volume of material to be photocopied
    • the costs exceed the maximum commitment for outlays provided in the substantive grant of aid
    • the proposed photocopying is being undertaken in the most economical manner.

If the request for photocopying is to provide the client with a copy of the material, the client must be in prison.

    Requirements

Practitioners seeking an extension of aid for photocopying should electronically submit an extension of aid request via the Grants Online system prior to photocopying the material.

    Interpretation

    The most economical manner

Where there is a large volume of material to be photocopied, Legal Aid Queensland may ask practitioners to obtain a quote from a commercial printing shop as photocopying fees at commercial rates can be more economical.

    Grant(s) of aid

The grant of aid for photocopying is COP.

    Review of decisions

A decision to refuse legal aid for this type of matter may be appealed to the external review officer (refer to review of decisions).
