How to access documents held by Legal Aid Queensland

Legal Aid Queensland’s (LAQ) Administrative Access Scheme is the best process to use if you are wanting to access documents from a legal file where LAQ acts/ed for you as your solicitor. You must apply in writing — use the Request to access documents held by Legal Aid Queensland form(PDF, 114KB) and provide evidence of your identity(PDF, 180KB). Publication Scheme and Disclosure Log

The Right to Information Act 2009 (RTI Act) and Information Privacy Act 2009 (IP Act) provides options for accessing information including our publication scheme and disclosure log (information released). Before making an application under the RTI/IP Act, you may check to see if the document you require is available in our publication scheme or disclosure log.

Right to Information and Information Privacy Access Applications

If you are unable to find the information you need through LAQ’s Administrative Access Scheme, in LAQ’s Publication Scheme or in LAQ’s Disclosure Log, you may make an application for documents under the RTI Act or IP Act. Requests under the RTI Act and IP Acts should only be made as a last resort if you are unable to find the documents you would like to access through LAQ’s other processes. This process is to be used to request documents only, it is not a way for you to request answers to questions.

Applications under both the RTI Act and the IP Act must be made in the approved form. You can submit a RTI and Information Privacy application form.

If the documents you request do not contain your own personal information, you must pay an application fee of *$55.75. This fee must be paid before your application can be processed and cannot be waived. You may also be charged for processing the application and for making copies of documents. More information about any processing or access fees and charges is available from the Queensland Government's Right to Information and Information Privacy website.

* Note: Application fee increased to $55.75 as at 1 July 2023. This fee increased by 3.4% on 1 July 2023 in line with Government's indexation policy.

How to amend documents

Under the IP Act you may apply for an amendment to a document that contains your personal information, if that document contains information that is inaccurate, incomplete, out of date or misleading.

You can submit an application on the Information Privacy Personal Information Amendment Application form.
