How we make decisions
Legal Aid Queensland officers making decisions as part of their duties are required to consult the relevant legislation, standards, delegations and procedures and follow an ethical decision making model.
Steps of the decision model:
- Define and record the key issues
- Determine the level of authority required to make the decision
- Read and understand the relevant legislation and Legal Aid Queensland's policies
- Determine those who will be affected by the decision
- Identify and understand the decision procedure
- Gather and record all the facts
- Observe natural justice
- Apply the law or policy to the facts
- Reasonably exercise discretion
- Document meaningful and accurate reasons.
Instrument of Delegation
Pursuant to Section 69 of the Legal Aid Queensland Act 1997, the Chief Executive Officer delegates decision making responsibilities to Legal Aid Queensland officers for the day to day management of the organisation.
These delegations are set out in the Instrument of Delegation and must be observed by all officers.
Risk Management Policy
Our Risk Management framework outlines how Legal Aid Queensland manages risk to achieve our strategic and business objectives by:
- embedding the culture of risk management
- integrating risk management with other organisational processes such as planning
- implementing systematic processes to identify, manage and monitor risk
- ensuring the risk management policy remains responsive.
