Legal aid has been granted for you to engage an agent to appear in court on your behalf where a personal appearance is required and it is more economical for an agent to be engaged. This is a maximum fee grant of aid. Claims can be made for actual time spent up to the maximum. This grant is in addition to the substantive grant of aid for the stage of matter and allows for the agents perusal of material and communicating with the principal. The agents claim for work covered by the substantive grant of aid (i.e. most court appearances) must be included in the solicitor's claim. Funding for parties in family law matters is subject to a cost cap. Refer to Guideline 18 – Family law costs management.
Legal aid has been granted for your solicitor to engage an agent to attend court on their behalf (in circumstances where it is more economical for an agent to be engaged). The maximum professional fee Legal Aid will pay your lawyer at this stage is $300.00 plus disbursements of $15.00. Funding for parties in family law matters is subject to a cost cap. Refer to Guideline 18 – Family law costs management.
Attendances Practitioners must claim for the actual time spent on a matter, up to the maximum allowable.
