Clause type: Approval
Investigate client's prospects of appeal against a conviction to the Court of Appeal. Fees payable on this grant are in accordance with the attached Proforma Invoices. Fees payable are for work done up to the maximum costs figure. Reasonable outlays will be paid. Receipts should be retained on file. The maximum fee payable on this invoice for disbursements is $50.00. Appeal Record Book Upon request and with proof that the matter is subject to a merit assessment funded by Legal Aid Queensland, the Court of Appeal Registry will provide the appeal record book on loan without charge. If aid is granted to fund the hearing of the appeal, then the Court of Appeal will issue an invoice for the cost of one copy of the appeal record book. A grant of aid will need to be requested and approved in order to cover that invoice. The invoice should then be paid by the firm to the Department of Justice and Attorney-General.
Investigate prospects of appeal against a conviction to the Court of Appeal. Legal Aid Queensland does not appear for applicants in hearings seeking an extension of time within which to appeal. Please note that Legal Aid Queensland does not file the notice of appeal on your behalf. You must file the Notice of Appeal in the court within one calendar month from the date of sentence (where a plea was entered) or the date of conviction (after a trial). If a Notice of Appeal is not filed within one month, Legal Aid Queensland is unable to assist you unless you are able to obtain an extension of time within which to file the Notice of Appeal.
