Investigate client's prospects of an appeal to the Mental health Court against a decision of the Mental Health Review Tribunal. The maximum costs payable on this grant are limited in accordance with the attached proforma invoices (including agent's fees). Fees payable are for work done up to the maximum costs figure. The maximum fee payable on this invoice for disbursements is $50.00
Legal aid has been approved for investigation of the merits of an appeal at this stage. Please note that Legal Aid Queensland does not file the Notice of Appeal Against Decision of Mental Health Review Tribunal (MHRT) on your behalf. You must file the Notice of Appeal in the Mental Health Court within 60 days from the day that you receive notice of the decision of the MHRT. If a Notice of Appeal is not filed within 60 days Legal Aid Queensland is unable to assist you unless you are able to obtain an extension of time within which to file the Notice of Appeal. You are encouraged to speak to a lawyer if you require advice or assistance in preparing the Notice of Appeal.
