Solicitor clause wording
Legal Aid may be available for an expert report in a criminal law matter when:
- The report is likely to substantiate a defence to the charges ( e.g. insanity), or
- The report directly relates to the proposed plea and it is likely to result in a significant reduction in the sentence that might otherwise be expected, and
- The material cannot be presented to the court without obtaining the report.
Based on the information provided, we do not believe the outlay for an expert report is warranted under the extent of funding guidelines.
