Solicitor clause wording
Legal aid is only available for the separate representative to obtain a social assessment report where; there is a current child protection application before the court; inspection of all available material has been undertaken; the matter would be significantly prejudiced without the report being obtained; a social assessment report is necessary to assist the court in its determination and either:
- the Department of Child Safety, Youth and Women has been contacted and refused a request to obtain the report, or
- it is not appropriate for the Department of Child Safety, Youth and Women to obtain the report, or
- an independent report is necessary and should be obtained by the Separate Representative, or
- any existing reports held by the Department are not sufficient to assist the court in its determination of the matter.
Based on the information provided, one or more of these criteria have not been met.
