Legal aid may make a grant of legal assistance for court proceedings in consumer protection matters under guideline 10.5 where: - The applicant has already participated in Internal Dispute Resolution and External Dispute Resolution and the parties have not resolved the dispute, or - participating in Internal Dispute Resolution and External Dispute Resolution is unavailable, impracticable or not appropriate in the circumstances, or - providing legal representation to the applicant for court proceedings would advance the public interest e.g. there is a significant point of law to be determined. and in addition guideline 10.5 (2) gives consideration of the: - complexity of the matter and - the particular circumstances of disadvantage of the client including - the extent of the impact on the client - practical difficulties in self representing - will be taken into account in determining the appropriateness of granting assistance. Based on the information you have provided, we do not believe your client's matter meets guideline 10.5 - Consumer protection matters because available dispute resolution was not accessed and granting aid for court is not in the public interest taking into account your circumstances and the complexity of the matter.
