Where an application for legal aid has property restrained due to current proceedings under the Criminal Proceeds Confiscation Act 2002, aid can only be granted if your client provides a signed charge over their property to Legal Aid Queensland to secure a refund of all costs and outlays expended in the matter and related criminal proceedings. As your client is not prepared to sign a charge over their property, aid is refused.
